Clear terms, fair for everyone.
The terms that govern your use of the Medineps Dental platform — for patients, dental professionals, and clinic administrators.
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Medineps Dental website, mobile applications, and platform (collectively, the “Service”), operated by Medineps (“Medineps”, “we”, “us”, or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Where a dental practice subscribes to the Service, these Terms apply alongside any separate agreement (such as a subscription or service agreement) between the practice and Medineps. If there is a conflict, the separate agreement governs for that practice.
2. Description of the Service
The Service provides dental practices with digital tools for patient management, interactive odontogram charting, treatment planning, procedure logging, lab case tracking, periodontal charting, imaging management, appointment scheduling, and practice analytics. It includes web applications for dental professionals and practice staff, along with supporting services such as notifications and reporting.
We may add, modify, or discontinue features over time. We will provide reasonable notice of material changes that affect how you use the Service.
3. Accounts and Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for safeguarding your credentials and for all activity under your account.
- Notify us immediately at hello@medineps.com.np if you suspect unauthorized access to your account.
- You must be at least 18 years old, or have the consent of a parent or guardian, to use the Service.
- We may suspend or close accounts that violate these Terms or that are inactive or misused.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law, including Nepali law.
- Attempt to access, probe, or interfere with the Service, systems, or other users' accounts.
- Upload malicious code, attempt to breach security, or reverse engineer the platform.
- Misrepresent your identity or impersonate another person or organization.
- Use the Service to store or transmit content that infringes intellectual property rights.
- Resell or sublicense the Service without our written consent.
5. Dental Data and Professional Responsibility
The Service is a tool to support — not replace — clinical judgment. Dental professionals remain responsible for the accuracy of the information they enter and for all decisions about patient care, diagnosis, and treatment.
Practices are responsible for:
- Ensuring they have lawful grounds to collect, process, and share patient information.
- Informing patients about how their data is used, in accordance with applicable privacy laws.
- Obtaining appropriate consents, including for health information where required.
- Maintaining their own backup, export, and record-retention practices.
Medineps is not a dental provider and does not provide dental advice through the Service.
6. Intellectual Property
The Service, including its software, design, logos, documentation, and content, is owned by Medineps or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business or personal purposes, subject to these Terms.
You retain all rights to the data you enter into the Service. You grant us a license to host, process, and use that data solely to operate and improve the Service on your behalf.
7. Fees and Payment
Fees for paid subscriptions are described in your subscription agreement or in the Service. Unless otherwise agreed, fees are payable in advance and are non-refundable except as required by law. We may change fees with reasonable notice; changes take effect at the start of the next billing period.
Accepted payment methods include eSewa, Khalti, bank transfers, and mobile banking.
8. Third-Party Services and Integrations
The Service may integrate with or link to third-party services (for example, payment gateways, SMS providers, or Cloudinary for media storage). These are governed by their own terms and privacy policies. We are not responsible for third-party services, but we will make reasonable efforts to select reliable partners and to notify you of material changes to integrations.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, and except where caused by our gross negligence or willful misconduct, Medineps is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.
10. Indemnification
You agree to indemnify and hold harmless Medineps and its officers, employees, and agents from any claims, losses, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of applicable law.
11. Termination
You may stop using the Service at any time and may close your account by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, indemnification, and limitation of liability — will survive.
Upon termination, you may export your data during a reasonable transition period. We will then delete or anonymize your data in accordance with our Privacy Policy and applicable law.
12. Governing Law and Disputes
These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles. Disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page with a revised “Last updated” date and, where appropriate, notify you by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
